The U.S. Federal Trade Commission (FTC) is the enforcement authority that has jurisdiction over OODC’s compliance with Privacy Shield, and OODC is subject to the investigatory and enforcement powers of the FTC. Please note that if your complaint is not resolved through these channels, OODC acknowledges the possibility, under certain limited conditions, for individuals to invoke binding arbitration before the Privacy Shield Panel to be created by the U.S. Department of Commerce and the European Commission.
Adherence by OODC to these Privacy Shield Principles may be limited (a) to the extent required to respond to a legal or ethical obligation; (b) to the extent necessary to meet national security, public interest or law enforcement obligations; and (c) to the extent expressly permitted by an applicable law, rule or regulation. OODC also acknowledges that it may be required to disclose Personal Information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.
Accountability for Onward Transfer: OODC will obtain assurances from third parties that they will safeguard Personal Information consistently with this Policy. Examples of appropriate assurances that may be provided by third parties include a contract obligating the third party to provide at least the same level of protection as is required by the relevant Privacy Shield Principles, being subject to Regulation (EU) 2016/679 the General Data Protection Regulation “GDPR”, or being subject to another European Commission adequacy finding (e.g., companies located in Canada). Where OODC has knowledge that a Processor is using or disclosing Personal Information in a manner contrary to this Policy, OODC will take reasonable steps to prevent or stop the use or disclosure. In cases of onward transfer to third parties of data of EU individuals received pursuant to the EU-US and Swiss-US Privacy Shield Frameworks, OODC is potentially liable.
